Internal Revenue Service Notice- CP211D Dear Sir or Madam: We are corresponding on behalf of the aforementioned client regarding your notice CP211D dated September 5, 2011. We hereby respectfully request a penalty not be assessed against this organization for failure to timely file Form 990. On July 21, 2011 well before the final due date, we filed on the client's behalf Form 8868 Application for Extension of Time to File an Exempt Organization Return. However, due to a computer system error the reason for the request on Line 7 did not print on the form and remained undetected. The request was to extend the due date until such time as all required information could be gathered or November 15, 2011 and the reason for the request for additional time was to gather information from third parties to properly file the return. On September 6, 2011 we received notification that the extension was denied because it did not include a statement explaining why additional time was needed. The notice further indicated that the return should be filed by the due date previously granted by the 3 month automatic extension. Unfortunately, the filing date was August 15, 2011 which is prior to the notice of rejection. Had we been notified prior to that date, we may have had an opportunity to do so. I would like to reiterate that our client is a non-profit ERISA employee benefit plan established to provide health benefits to its eligible participants and their dependents and as such a penalty will cause significant economic hardship on the Fund as the assets and reserves would not be used for their intended purpose.
