The Internal Revenue Service and certain state taxing authorities have determined that various income items are subject to Unrelated Business Income Tax (UBIT). The IRS Code has very limited guidance on what activities should be subject to UBIT. Some Technical Advice Memorandums (TAM) have been issued relating to this matter. Currently, there is lawsuit pending against the Internal Revenue Service challenging UBIT. Two credit unions, in two different federal districts, have been successful in challenging the IRS's interpretation of Unrelated Business Income Tax rules. This does not officially change the position of the IRS in these matters.
