FIN 48 FOOTNOTE The Credit Union is exempt, by statute, from Federal income taxes under Internal Revenue Code Section 501(c)(14) and state income taxes. Deferred compensation The Credit Union has initiated a non-qualified deferred compensation and incentive agreement to provide retirement incentive benefits for the CEO. The Credit Union deposited $1,000,000 into a rabbi trust account which was invested in a various securities. The deferred compensation plan vests on April 19, 2024. The CEO will be entitled to the income earned on the primary deposit at the maturity date, subject to certain employment conditions and commitments. The Credit Union retains the rights to the principal balance, which will be released at maturity. The income earned each year is reinvested. The Credit Union recognizes the investment income reinvestment while also recording the corresponding deferred compensation liability obligation. The income (loss) incurred on the trust asset, and the corresponding benefit expense (income) amounted to $99,952 and $153,606 for the years ended December 31, 2010 and 2009, respectively, and are reflected in the Statement of Income. All trust assets are considered assets of the Credit Union.
