| Part II, Line 17b--The organization meets the "facts and circumstances" test in Temporary Regulations section 1.170A-9T(f)(3) as its sources of support are as varied as possible, the governing body represents the broad interests of the public, and the organization generally provides facilities or services directly for the benefit of the general public on a continuing basis. Given the technical and specialized nature of the organization's charitable purpose of treating blindness in Southeast Asia through education, training, medical supplies and research, the availability of quality intraocular lenses for use in surgery to eliminate blindness is limited. Therefore, by necessity, the organization receives frequent and repeated contributions from the same donors who are able to contribute those medical supplies of the appropriate quality. As shown in Form 990, Part VII, the governing body of the organization is comprised of a variety of doctors and non-doctors who represent the broad interests of the public. The governing body is not comprised of a limited number of close acquaintances, but rather a diverse group of businessmen and doctors who guide the overall purpose of the entity.Finally, the services that the organization provides are provided to individuals in Southeast Asia who are without relationship or connection to the organization itself or any of its board members. All those who are in need to treatment to cure blindness or who are doctors wishing to learn skills in order to perform these operations are welcome to contact the organization for their services. |
