Supplemental Information. Complete this part to provide the explanation required by Part II, line 10; Part II, line 17a or 17b; or Part III, line 12. Also complete this part for any additional information. (See instructions).
Facts And Circumstances Test
Part II, Line 17a--Excellence in Education Foundation ("EEF") submits that throughout its existence to date and in the future, it qualifies as a public charity under Internal Revenue Code 509(a)(1) by satisfying the requirements of Treasury Regulations 1.170A-9(e)(3) as follows:(i). Ten Percent Test: EEF has historically, and normally can be expected to in the future, received over 10% of its total support from the general public; the ratio for the past five years was approximately 30%. (ii). Attraction of Public Support: EEF was formed in 2006 and has slowly but steadily expanded its list of donors. EEF's fundraising efforts are always open and we look for a wide variety of people and organizations to support our research. As EEF works to demonstrate to contributors how funds are being used to provide research, data and other timely information to the leadership of the state, as well as, public stakeholders, the public support is expected to grow.(iii). Percentage of Financial Support: EEF received approximately 30% of its total support from public sources during the past five years and can reasonably expect that ratio to be sustained in the future. (iv). Sources of Support: EEF receives its support from a representative number of foundations and individuals, rather than the members of a single family or small group of individuals. EEF has to date received gifts from over 27 contributors. During the current fiscal year, several new pledges of support have been received. (v) Representative Governing Body: EEF's governing body is composed of 5 civic and business leaders. Our board, albeit small, is representative of interests relevant to our mission. (vi). Availability of Facilities or Services and Public Participation: EEF is designed to support research and education (public awareness) in the areas of public and higher education. We are involved with public policy and provide research to state task forces and commissions (in the area of education) as appropriate.CONCLUSION: EEF believes it qualifies as a publicly supported charity described in IRC 509(a)(1) pursuant to the facts and circumstances test found in Treasury Regulation 1.170A-9(e)(3). EEF has and will receive well in excess of ten percent (10%) of its total support from qualifying public sources. It indirectly serves all of the school children attending public schools in the United States through its efforts to research and educate about public education. EEF is governed by a public board and possesses all the characteristics that describe organizations that meet this test. Most significantly, EEF is organized and operates to pursue uniquely public purposes, the betterment of public schools. As a result, EEF actively seeks public input and support and responds solely to public needs.
