Facts And Circumstances Test
Explanation
There is $2000 listed as other income for the 2009 return on the Schedule A. I believe this is the money we received from Frys Food Stores for linking customer reward cards with our school. We receive $500 per quarter if we reach their maximum purchase threshold. We now designate this money under line 1 on the return.

A notice was sent advising that we were missing some information on the return we submitted, however, this mail was not delivered by the school to the current Treasurer until recently. Upon review of the return, it was found that the return was prepared incorrectly and that it would be necessary to amend the return in addition to providing the missing information requested. This was quite time consuming as I was unfamiliar with the finances from that year and was provided incorrect information on how to file when the initial return was prepared. It would be appreciated if the penalties could be waived as we have been in compliance in the past and were unaware that these were being applied until recently.

Please note that there was an original delay in filing due to the fact that the Treasurer, Dave Ortegon, was deployed overseas with the military. We filied for an extension hoping he would return prior to the return being due. When he did not return, we reviewed the financials we had on hand and prepared the return to the best of our ability. We were unaware that our original return was incomplete and therefore, considered not received. Once we were made aware of this issue, we reviewed the original returned with the completed year end financials and saw that there were several errors in the original return. We opted to amend the return so it would be correct and also provide the missing information requested. Please consider removing the penalities applied as this would be a significant cost to our organization which could be spend on our grants and programs. Thank you.
