LINER SHIPPING REGULATORY SYSTEM -------------------------------- The Council followed the various regulatory activities of the Federal Maritime Commission under the Shipping Act regulatory regime, including submitting public comments on the Commission's inquiries about the possible creation of export rate indexes and about the consequences of U.S. harbor maintenance taxes.

U.S. MARITIME SECURITY ISSUES ------------------------------- The World Shipping Council ("WSC"), working with its Security Advisory Committee is comprised of representatives of member companies, and addressed various maritime security policies and concerns for the international liner shipping industry, and provided analysis and advice to the U.S. government on various security policy issues and programs. The following are some of the specific issues in which the Council is involved: A. Piracy: The Council has been working within the International Maritime Organization structure to address the issue of piracy in the Gulf of Aden and Indian Ocean. WSC participated in the revision of "best management practices", which is a joint government-industry effort to reduce the risks in the region. B. U.S. Maritime Security and Safety Regulation: Incorrectly declared weights of containerized shipments continue to present safety issues for container stowage and ship operations. WSC has undertaken an effort at the International Maritime Organization and with IMO member governments in support of developing an international requirement that all such containers be weighed before vessel loading. WSC also cooperated with the U.S. government in support of this initiative. C. International Labor Organization ("ILO"): A "Global Dialogue Forum on Safety in the Supply Chain in Relation to Packing of Containers", organized by the ILO, agreed to recommend to the IMO, ILO and UNECE that the existing "IMO/ILO/UNECE Guidelines for packing of cargo transport units ("CTUs")" be revised to become a "Code of Practice", applicable to the whole supply chain and to all modes of transport. The ILO's Governing Body has approved this recommendation, and so has the IMO's Maritime Safety Committee (MSC). WSC is participating in the working group meetings to develop the draft "Code of Practice". D. Container Tracking Devices ("CTDs"): WSC worked with the International Standardization Organization ("ISO") on the issue of whether and how to develop international technical standards for container tracking devices. E. Customs and Border Protection ("CBP") Automation Initiatives: WSC has worked with CBP in developing plans for automating the electronic filing of export manifests, and also worked with CBP in transitioning the manifest filing systems from CBP's Automated Manifest System ("AMS") to the ACE ocean/rail manifest ("M1"). F. European Commission Container Security Regulation: The Council engaged in continuous dialogue with the European Commission on issues pertaining to the European Community's 24 Hour Rule initiative and the related Authorized Economic Operator ("AEO") program, including detailed technical discussions regarding the form, content, and filing methods for entry and exit summary declarations. In 2007 the European Union enacted the Modernized Customs Code ("MCC"). While it has entered in to force, the MCC does not become effective until the Commission promulgates implementing provisions ("MCCIPs"), likely to occur by mid-2013. In order to bring the MCC into effect, the Commission is revising the existing Customs Code implementing provisions in order to promulgate new MCCIPs. G. World Customs Organization ("WCO"): The Council has worked with the World Customs Organization on a number of supply chain security issues, including review of the data elements in the international SAFE Framework that should be provided to Customs authorities.

ENVIRONMENTAL ISSUES ------------------------------------------- A. Vessel Air Emissions The Council worked on the following government initiatives dealing with vessel air emissions: 1) The U.S. - Canadian 200 mile emission control area adjacent to North American shores to reduce sulfur, NOx ("nitrogen oxide") and particulate matter emissions. 2) Various proposals at the IMO to address carbon emissions from ships. The Council has consultative status at the International Maritime Organization as an expert organization to represent the liner shipping industry at this United Nations agency, and has presented a comprehensive proposal for a binding greenhouse gas regulatory structure. B. Ballast Water Regulations Legislation: The Council has worked in support of Congressional legislation on this issue. Regulatory: The Council worked to provide input to EPA for its consideration in promulgating a new vessel general permit, and to the Coast Guard as it addresses the issue through its separate statutory authority. The Council also worked with the States of New York and California on their efforts to address of ballast water regulations. C. Whale Protection The Council worked with the National Oceanic and Atmospheric Administration regarding measures to reduce ship strikes of North Atlantic right whales and Pacific Coast whale populations off California.

PROGRAM SERVICE ACCOMPLISTMENTS PART III, LINE 4D I. CARGO LIABILITIY ------------------------------------------------------ The Council was a member of the U.S. delegation to the United Nations Commission on International Trade Law ("UNCITRAL") negotiations on developing a new international cargo liability convention, known as the Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea. The convention has been signed numerous by UN member states, and it will enter into force after ratification by 20 countries. The new convention contains most of the elements included in the WSC agreement with the National Industrial Transportation League at the beginning of the UNCITRAL negotiation process. This carrier-shipper alliance has been extremely effective, and its positions are heavily reflected in the new convention. The Council continues to work with the United States Department of State to position the convention for ratification by the United States. II. Public Relations ------------------------------------------------------- The Council undertakes various initiatives to better explain the international liner shipping industry to the public and interested government officials. This may take place through Congressional testimony, filings with regulatory agencies, and public speeches. Another way the Council does this is through its website, which can be found at www.worldshipping.org, which provides further details on the work of the Council.
