Part X Part X : FIN48 Footnote The Fund applies the provisions of Financial Accounting Standards Board ASC 740, Income Taxes, which provides guidance for how uncertain tax positions should be recognized, measured, presented and disclosed in the financial statements. This guidance requires the evaluation of tax positions taken or expected to be taken in the course of preparing the Fund's financial statements to determine whether the tax positions are "more-likely-than-not" of being sustained by the applicable tax authority. Tax positions with respect to tax not deemed to meet the "more-likely-than-not" threshold would be recorded as a tax benefit or expense in the year. Management has concluded that there is no tax benefit or expense to be recorded for uncertain tax positions by the Fund for the years ended May 31, 2012 and 2011 or any previous year.The tax returns of the Fund for the years ended May 31, 2009, 2010 and 2011 are subject to examination by the applicable tax authority, generally for three years after they were filed.

Identifier Return Reference Explanation
Schedule R - Identification of Related Organizations   The filing organization is a Multiemployer Trust that provides Health and Welfare Benefits to eligible participants and their eligible dependents as well as certain Benefits to eligible former participants and their eligible spouses. The Trust is exempt from tax under Internal Revenue Service Code Section 501(c)(9). As of May 31, 2012 there were 389 employers that contributed to the Trust. The filing organization maintains a database of the names of these contributing employers and the amount contributed to the Trust by each employer. Certain information that is required to be reported on Schedule R such as the Employer Identification Number and legal structure (Corporation, Partnership, etc) for each contributing employer is not on file with the filing organization and could not be reasonably obtained nor is required to be maintained by the filing organization. As a result, only the names of the contributing employers are provided as an attachment to the Schedule R. See the "Attachment To Form 990 - Schedule R - 2011".
