IN ORDER TO SATISFY THE FACTS AND CIRCUMSTANCES TEST, AN ORGANIZATION MUST MEET THE FOLLOWING REQUIREMENTS AS DISCUSSED IN TEMPORARY REGULATIONS SECTION 1.170A-9T(F)(3): i. TEN PERCENT SUPPORT LIMITATION - THE TOTAL AMOUNT OF GOVERNMENTAL AND PUBLIC SUPPORT NORMALLY RECEIVED EQUALS AT LEAST 10% OF THE TOTAL SUPPORT NORMALLY RECEIVED BY THE ORGANIZATION. THE ORGANIZATION HAS A PUBLIC SUPPORT PERCENTAGE OF 31.98% FOR 2012 AND 29.78% FOR 2011. ii. ATTRACTION OF PUBLIC SUPPORT - THE ORGANIZATION MAINTAINS A CONTINUOUS AND BONA FIDE PROGRAM FOR SOLICITATION OF FUNDS FROM THE GENERAL PUBLIC AND COMMUNITY AND IT CARRIES ON ACTIVITIES DESIGNED TO ATTRACT SUPPORT FROM OTHER ORGANIZATIONS. THE ORGANIZATION PROVIDES GRANTS TO OTHER ORGANIZATIONS THAT CONDUCT MANUFACTURING DAY CAMPS AND ISSUES SCHOLARSHIPS TO COLLEGE AND TRADE SCHOOL STUDENTS. THE ORGANIZATION REGULARLY SOLICITS IN PERIODIC NEWSLETTERS AND VIA THE ORGANIZATION'S WEBSITE. iii. ADDITIONAL FACTORS TO BE CONSIDERED IN DETERMINING WHETHER AN ORGANIZATION IS "PUBLICLY SUPPORTED" - A. PERCENTAGE OF FINANCIAL SUPPORT - THE PERCENTAGE OF SUPPORT RECEIVED BY THE ORGANIATION FOR 2012 WAS WELL ABOVE THE 10% REQUIREMENT. IT WAS 31.98%. B. SOURCES OF SUPPORT - THE ORGANIZATION MET THE REQUIREMENT OF PARAGRAPH (f)(3)(i) ABOVE. THE MAJORITY OF THE ORGANIZATIoN'S SUPPORT IS FROM FABRICATORS & MANUFACTURERS ASSOCIATION INTERNATIONAL (FMA INTERNATIONAL), AN ORGANIZATION EXEMPT UNDER IRC SECTION 501(C)(3) AND A PUBLICLY SUPPORTED ORGANIZATION DESCRIBED IN SECTION 509(A)(2). THE REMAINDER OF THE ORGANIZATION'S SUPPORT IS FROM A DIVERSE GROUP OF FABRICATORS, MANUFACTURERS, CAMP SUPPORTERS AND THE GENERAL PUBLIC. C. REPRESENTATIVE GOVERNING BODY - THE GOVERNING BODY REPRESENTS THE BROAD INTERESTS OF THE PUBLIC AND NOT THE PERSONAL INTERESTS OF A LIMITED NUMBER OF DONORS. THE GOVERNING BODY IS NOT MADE UP OF INDIVIDUALS FROM ONE SINGLE FAMILY; RATHER, THE BOARD IS COMPRISED OF A BROAD MIX OF UNRELATED MEMBERS FROM THROUGHOUT NORTH AMERICA. D. AVAILABILITY OF PUBLIC FACILITIES OR SERVICES; PUBLIC PARTICIPATION IN PROGRAMS - (1) THE ORGANIZATION PROVIDES GRANTS TO OTHER NOT-FOR-PROFIT ORGANIZATIONS THAT HOLD ANNUAL MANUFACTURING SUMMER CAMPS AND IT PROVIDES SCHOLARSHIPS DIRECTLY FOR THE BENEFIT OF THE GENERAL PUBLIC ON A CONTINUING BASIS. (2) THERE IS PARTICIPATION IN THE PROGRAMS OF THE ORGANIZATION BY MEMBERS OF THE PUBLIC HAVING SPECIAL KNOWLEDGE OR EXPERTISE. FOR EXAMPLE, THE MANUFACTURING SUMMER CAMPS UTLIZE COMMUNITY COLLEGES AND OUTSIDE STAFF.
