There was supposed to be a change in the position of officer for the organization. Sarah Mitchell, treasurer for the 7/1/12-6/30/13 time period was to be replaced by another person, and trained this person to take over duties. The replacement treasurer was from out of town and it was difficult to get in town for meetings, fiscal updates, etc. Sarah was working full time and had trouble getting in touch with replacement treasurer and other officers (who are all volunteer with other jobs). Upon checking in with the replacement treasurer (who is very new to non-profit organizations and treasurer duties and was dealing with a death in the family), it was brought to Sarah's attention that taxes had not been filed by the due date for this fiscal period, and an application for extension was also not filed by the due date. As soon as Sarah found out about this lapse, she returned as treasurer (a job change has allowed her more time), and began filing process immediately. This will not happen again, as Sarah will continue to be involved in the organization and has been and will continue to be on top of filing deadlines. The late filing for 2012 was absolutely a one time occurrence. We essentially have no "income" since we spend more on rent and utilities to keep the doors open than we receive in donations. Other expenses include supporting a youth LGBT program. We believe we should not be charged penalties due to the switching of duties and positions within the organization, as well as the fact, that what little money we make goes to keeping the doors open and supporting programming. The organization operated in good faith, and we believe the facts and circumstances outlined above support an abatement of the penalty especially given that steps have been taken to ensure that all future filings will be timely.
