THE FOLLOWING FACTORS CONFIRM THAT THE HOWARD AND GEORGEANNA JONES FOUNDATION FOR REPRODUCTIVE MEDICINE (EIN 54-1265842) CONTINUES TO QUALIFY AS A PUBLICLY SUPPORTED ORGANIZATION UNDER THE FACTS-AND-CIRCUMSTANCES TEST OF TREASURY REGULATION SECTION 1.170(A)-9(F)(3):(I) TEN PERCENT-OF-SUPPORT LIMITATION. THE FOUNDATION'S PUBLIC AND GOVERNMENTAL SUPPORT NOT ONLY EXCEEDS THE 10% MINIMUM BUT IS SLIGHTLY UNDER THE 33 1/3% SAFE HARBOR. (II) ATTRACTION OF PUBLIC SUPPORT. THE FOUNDATION SOLICITS CONTRIBUTIONS TO FURTHER MEDICAL RESEARCH AND EDUCATION THROUGH ITS SEMIANNUAL NEWSLETTER JONES JOURNAL, A WEBSITE THAT IS INFORMATIVE AND DEDICATED TO ACCEPTING ONLINE RESEARCH APPLICATIONS AND CONTRIBUTIONS (WWW.JONESFOUND.ORG) , PUBLICATIONS ABOUT MEDICAL RESEARCH PROGRESS, PERIODIC ETHICAL SEMINARS, AND A MAILING LIST THAT INCLUDES APPROXIMATELY 2,500 PHYSICIANS, RESEARCHERS, INDIVIDUAL SUPPORTERS, CORPORATIONS AND FOUNDATIONS.(III) PERCENTAGE OF FINANCIAL SUPPORT. THE FOUNDATION'S PUBLIC SUPPORT PERCENTAGE FOR 2013 IS 27.11%, BARELY SHORT OF THE 33 1/3% SAFE HARBOR. BASED ON CURRENT PROJECTIONS, THE FOUNDATION ANTICIPATES THAT ITS GOVERNMENTAL AND PUBLIC SUPPORT FOR 2014 WILL EXCEED 34%.(IV) SOURCES OF SUPPORT. THE FOUNDATION RECEIVES SUPPORT FROM A BROAD AND DIVERSE GROUP OF DONORS. IT SENDS AN ANNUAL APPEAL TO APPROXIMATELY 2,500 SUPPORTERS IN A CONTINUING ATTEMPT TO ATTRACT DONORS AND SUPPORT OF BASIC SCIENCE RESEARCH IN REPRODUCTIVE MEDICINE. THE FOUNDATION RECENTLY APPROVED A BOARD GIVING POLICY TO REQUIRE MEMBER MINIMUM CONTRIBUTIONS OF $10,000, OR THE EQUIVALENT BY SOLICITATION. IN THE PAST YEAR THE FOUNDATION RECEIVED OVER $400,000 AS PART OF A MATCHING CONTRIBUTION REQUIREMENT TO ITS RESEARCH ENDOWMENT FUND.(V) REPRESENTATIVE GOVERNING BODY. THE FOUNDATION'S 22-MEMBER GOVERNING BOARD INCLUDES SIX PHYSICIANS WITH EXTENSIVE EXPERIENCE IN ENDOCRINOLOGY OR OBSTETRICS AND GYNECOLOGY, SEVEN LAWYERS, ONE OF WHOM IS AN ATTORNEY FOR HEALTHCARE ISSUES AND THE VICE CHAIRMAN WHO IS A RENOWNED ATTORNEY IN PATENT PROTECTION AND LITIGATION, THREE BANKERS, TWO CHIEF EXECUTIVES OF MAJOR BUSINESSES, TWO RETIRED COMMUNITY VOLUNTEERS, AN INDIVIDUAL WITH A DOCTORATE IN ECONOMICS AND THE FOUNDATION'S LONGTIME EXECUTIVE DIRECTOR AND PRESIDENT. THE BOARD BENEFITS FROM THE ADVICE OF TWO OTHER GROUPS. THE MEDICAL EXECUTIVE COMMITTEE CONSISTS OF SIX PHYSICIANS WHO ARE LEADERS IN THE FIELD OF REPRODUCTIVE MEDICINE. THEY REVIEW GRANT APPLICATIONS AND EDUCATIONAL PROGRAMS, AND OFFER ADVICE AS NEEDED TO THE FOUNDATION BOARD OF DIRECTORS. THE MEDICAL ADVISORY COUNCIL CONSISTS OF 20 PHYSICIANS, ALSO LEADERS IN REPRODUCTIVE MEDICINE, WHO ASSIST IN REVIEWING GRANT APPLICATIONS AND SELECTING GRANTEES AND PROVIDE OTHER ADVICE TO THE BOARD AS REQUESTED.(VI) AVAILABILITY OF PUBLIC FACILITIES OR SERVICES; PUBLIC PARTICIPATION IN PROGRAMS OR POLICIES. THE FOUNDATION INFORMS MEDICAL PROFESSIONALS AND THE INTERESTED PUBLIC ABOUT MEDICAL RESEARCH DEVELOPMENTS AND AVAILABLE GRANTS THROUGH ITS SEMIANNUAL JOURNAL AND ITS WEBSITE. IT ALSO SPONSORS AN ANNUAL MEDICAL LECTURESHIP AND MONTHLY ETHICS SEMINARS. (VII) RECOGNITION BY MEDICAL COMMUNITY. THE FOUNDATION HAS BECOME A SIGNIFICANT FORCE IN PROVIDING PHILANTHROPIC SUPPORT FOR THE NARROW FIELD OF REPRODUCTIVE MEDICAL RESEARCH THAT IS UNDERFUNDED AND NOT SUPPORTED BY GOVERNMENT GRANTS.
