Facts And Circumstances Test
DURING THE PAST FEW YEARS, THE FOUNDATION HAS RECEIVED SEVERAL LARGE DONATIONS FROM AN INDIVIDUAL, WHO IS IN AN END OF LIFE SITUATION, AND FROM A FEW ESTATES. THIS INDIVIDUAL IS A RETIRED SCHOOL TEACHER, WHO IS CONCERNED ABOUT THE YOUTH OF THIS SMALL, RURAL COMMUNITY. THE DONATIONS ARE UNRESTRICTED AND THE INDIVIDUAL HAS NOT PARTICIPATED IN DECISION-MAKING REGARDING ITS EXPENDITURE OR INVESTMENT, NOR WILL HE DO SO. THE DONOR HAS EXPRESSED HIS INTENT TO MAKE ADDITIONAL DONATIONS DURING HIS LIFETIME AND HAS INFORMED THE FOUNDATION THAT IT IS INCLUDED IN HIS ESTATE PLANNING. THE DONATIONS FROM THE ESTATE IN PAST FIVE YEARS HAVE BEEN RECEIVED WITH NO PRIOR KNOWLEDGE OR SOLICITATION AND HAVE BEEN UNRESTRICTED. THESE DONATIONS CAUSE THE FOUNDATION TO NO LONGER MEET THE PUBLIC SUPPORT TEST. THE FACTS AND CIRCUMSTANCES OF THESE GIFTS AND THE OTHER CONDITIONS EXPERIENCED BY THE FOUNDATION OVER THE PAST FIVE YEARS THAT HAVE AFFECTED ITS FUNDRAISING, HOWEVER, PROVIDE A COMPELLING REASON TO CONTINUE TO CLASSIFY THE FOUNDATION AS A PUBLICLY SUPPORTED ENTITY. OTHER DONATIONS DURING THE PAST FIVE YEARS HAVE BEEN MINIMAL BECAUSE THE COMMUNITY HAS BEEN PARTICULARLY HARD HIT BY THE CURRENT ECONOMIC CONDITIONS. A FORMER MINING COMMUNITY, THE IRONWOOD AREA BEGAN EXPERIENCING A HIGH UNEMPLOYMENT RATE AND A DECLINING POPULATION DURING THE LAST DECADE. THE NATIONAL ECONOMIC DOWNTURN OF THE PAST SEVERAL YEARS INCREASED THE PRESSURE ON THOSE INDIVIDUALS AND BUSINESSES OF MEANS TO SUPPORT THE CHARITABLE ORGANIZATIONS PROVIDING BASIC NECESSITIES TO THOSE IN NEED. AS A RESULT, THE FOUNDATION HAS BEEN FAR LESS SUCCESSFUL IN ITS FUNDRAISING DURING THIS PERIOD. ALTHOUGH THE BOARD CONTINUES TO SOLICIT FUNDS, THIS ECONOMY HAS MADE IT VERY DIFFICULT FOR THE BOARD TO SOLICIT DONATIONS FROM THE GENERAL PUBLIC RECEIVING A 60,000 DONATION FROM TWO ESTATES ALONG WITH NUMEROUS SMALLER DONATIONS IN THE CURRENT YEAR. THAT BEING SAID, THE BOARD HAS EVERY HOPE THAT DONATIONS WILL PICK UP IN FUTURE YEARS. THE FOUNDATION IS GOVERNED BY A VOLUNTARY, ACTIVE BOARD THAT IS REPRESENTATIVE OF THE COMMUNITY. OTHER THAN INVESTMENT AND ACCOUNTING FEES, ALL ACTIVITIES OF THE FOUNDATION ARE ON A VOLUNTEER BASIS AND ALL FUNDS SUPPORT SCHOLARSHIPS. ALTHOUGH THE FOUNDATION FAILED TO MEET THE PUBLIC SUPPORT TEST, IT SHOULD CONTINUE TO BE CONSIDERED A PUBLIC CHARITY BECAUSE THE GIFTS RECEIVED FROM THESE SUPPORTERS ARE NOT SUBJECT TO ANY CONDITIONS THAT MIGHT GIVE THE DONOR CONTROL AND BECAUSE THE CURRENT ECONOMY OF THE AREA HAS CAUSED A SIGNIFICANT BUT TEMPORARY DROP IN GENERAL DONATIONS. THE FACTS AND CIRCUMSTANCES OF THIS SITUATION SUPPORT CONTINUATION OF THE FOUNDATION AS A PUBLIC CHARITY.
