THE INTERNAL REVENUE SERVICE ("irs") ISSUED A LETTER DATED NOVEMBER 15, 1993, STATING THAT THE TRUST IS QUALIFIED PURSUANT TO SECTION 501(C)(9) OF THE INTERNAL REVENUE CODE. THE TRUST HAS BEEN AMENDED SINCE RECEIVING THE DETERMINATION LETTER. HOWEVER, THE PLAN ADMINISTRATOR, HAVING CONSULTED WITH THE PLAN'S LEGAL COUNSEL, BELIEVES THAT THE TRUST REMAINS TAX-EXEMPT AS OF THE FINANCIAL STATEMENT DATE. US GAAP REQUIRES PLAN ADMINISTRATOR TO EVALUATE TAX POSITIONS TAKEN BY THE PLAN. THE FINANCIAL STATEMENT EFFECTS OF AN UNCERTAIN TAX POSITION ARE RECOGNIZED WHEN THE POSITION IS MORE LIKELY THAN NOT, BASED ON THE TECHNICAL MERITS, TO BE SUSTAINED UPON EXAMINATION BY TAXING JURISDICTIONS.
