Facts And Circumstances Test
Explanation
Mercy Health Foundation Northwest Arkansas is a nonprofit charitable organization that is organized to raise funds in support of Mercy Health and its subsidiaries, and to fund community health and education programs. The foundation qualifies as publicly-supported because it meets the "10% plus facts and circumstances" under Treas. Reg. 1.170A-9(E)(3) in the following respects: 1. 10% of Support Limitation - Mercy Health Foundation Northwest Arkansas Foundation's public support percentage is 18.24%, which is well above the 10% threshold. 2. Sources of Support - Mercy Health Foundation Northwest Arkansas Foundation is organized and operated to attract new and additional support on a continuous basis. The foundation attracts both corporate and individual donors; there have been hundreds of donors over the preceding 5-year period. 3. Representative governing body - The foundation had an 18-member governing body as of June 30, 2013. 17 of the 18 members are independent voting members representing a broad cross-section of the foundation's community, and represent the broad interests of the public.

THE MERCY FOUNDTAION OF NWA SUPPORTS MERCY HOSPITAL OF NWA. IT HAS TWO MAIN FUNDRASING EVENTS TO HELP RAISE FUNDS INCLUDING A CHARITY BALL AND A GOLF TOURNAMENT. THESE EVENTS ARE USED TO RAISE MONEY FOR MEDICAL EQUIPMENT NEEDS AND GROWTH OF THE HOSPITAL. THE FOUNDATION ALSO RAISES MONEY TO SUPPORT THE CO-WORKERS OF THE HOSPITAL THROUGH AN EMPLOYEE CRISIS FUND AND A MERCY WAY DRIVE, WHICH SUPPORTS THE HEALTH CARE OF THE HOSPITAL EMPLOYEES. THE FOUNDATION ALSO RAISES FUNDS TO SUPPORT THE UNITED WAY. FORM 990, PART V, QUESTION 1A FORM 1099/1096 FILING VENDORS FOR THE FILING ORGANIZATION ARE PAID BY MERCY HEALTH (EIN 43-1423050).
