    THIS STATEMENT IS SUBMITTED IN ACCORDANCE WITH REG. 1.6043-3(A)(1) AND FORM 990-PF GENERAL INSTRUCTION T TO REPORT DISTRIBUTION OF CERTAIN ASSETS THAT RESULTED IN A SUBSTANTIAL CONTRACTION OF ASSETS DURING THE CURRENT TAX YEAR. UPON THE REQUEST OF TWO OF THE FIVE BOARD OF DIRECTORS, 2/5'S (40%) OF THE FAIR MARKET VALUE OF THE FOUNDATIONS ASSETS AS OF JANUARY 31, 2013 WERE TRANSFERRED TO A DONOR ADVISED FUND AT THE EAST TEXAS COMMUNITIES FOUNDATION, EIN 75-2309138, 315 N BROADWAY AVE, TYLER, TX 75702. THE EAST TEXAS COMMUNITIES FOUNDATION IS EXEMPT FROM TAXES UNDER IRC SEC. 501(C)(3) AND IS AN ORGANIZATION THAT NORMALLY RECEIVES A SUBSTANTIAL PART OF ITS SUPPORT FROM A GOVERNMENTAL UNIT OR FROM THE GENERAL PUBLIC DESCRIBED IN SECTION 170(B)(1)(A)(VI). THE EAST TEXAS COMMUNITIES FOUNDATION IS NOT CONTROLLED DIRECTLY OR INDIRECTLY BY THE RIEHM FAMILY FOUNDATION OR ANY DISQUALIFIED PERSONS WITH RESPECT TO THE RIEHM FAMILY FOUNDATION. NONE OF THE FUNDS TRANSFERRED WERE TREATED AS A QUALIFYING DISTRIBUTION. THE REASON FOR THE TRANSFER TO THE DONOR ADVISED FUND WAS TO RESOLVE DISAGREEMENTS AMONG THE FAMILY BOARD OF DIRECTORS. THE TWO BOARD MEMBERS WHO REQUESTED THE TRANSFER RESIGNED FROM THE RIEHM FAMILY FOUNDATION BOARD IN FEBRUARY 2013 WHEN A MAJORITY OF THE ASSETS WERE TRANSFERRED TO THE EAST TEXAS COMMUNITIES FOUNDATION. A TRANSFER OF 237,378.91 OF CASH OCCURRED DURING FEBRUARY 2013 AND 4.499.95 DURING MAY 2013 FOR A TOTAL CASH TRANSFER OF 241,878.86. THE TRANSFER OF THE STOCKS AND MINERAL AND ROYALTY INTEREST OCCURRED DURING FEBRUARY 2013.
