- THE PRESERVATION AND ENRICHMENT OF WYOMING'S AGRICULTURAL HERITAGE AND RURAL LIFESTYLE. - THE CONSERVATION OF WYOMING'S UNIQUE LAND, MINERAL, WATER, AND CLEAN AIR RESOURCES CONSISTENT WITH RESPONSIBLE USE OF THOSE RESOURCES TO SUSTAIN THE LIVELIHOOD OF PRESENT AND FUTURE GENERATIONS. - THE EDUCATION AND EMPOWERMENT OF WYOMING'S CITIZENS TO RAISE A COHERENT VOICE IN THE DECISIONS THAT WILL IMPACT THEIR ENVIRONMENT AND LIFESTYLE.

POWDER RIVER PUBLISHES THE POWDER RIVER BREAKS ON A BIMONTHLY BASIS FROM JANUARY/ FEBRUARY TO NOVEMBER/DECEMBER OF EACH YEAR. THIS 8 TO 16 PAGE NEWSLETTER CONTAINS INFORMATION ON THE DIFFERENT PROJECTS UNDERTAKEN BY POWDER RIVER IN THE PAST MONTHS. IT IS PROVIDED TO MEMBERS AND IS AVAILABLE TO THE PUBLIC AT DESIGNATED DROP SITES. POWDER RIVER MAINTAINS A WEBSITE AT WWW.POWDERRIVERBASIN.ORG THAT INFORMS AND EDUCATES THE PUBLIC ON CONSERVATION ISSUES THAT POWDER RIVER BASIN RESOURCE COUNCIL IS ADDRESSING. POWDER RIVER BASIN RESOURCE COUNCIL MAINTAINS TWO OFFICE LOCATIONS IN WYOMING. THE MAIN OFFICE IS LOCATED IN SHERIDAN AND THE OTHER IN CLARK. POWDER RIVER'S WORK IS OVERSEEN BY THE POWDER RIVER BASIN RESOURCE COUNCIL BOARD OF DIRECTORS. BOARD MEMBERS ARE ELECTED FROM AND BY THE POWDER RIVER MEMBERSHIP FOR A TWO YEAR TERM. AS A GRASSROOTS ORGANIZATION, MEMBERS DECIDE THE DIRECTION AND FOCUS OF POWDER RIVER'S WORK. MEMBERS BRING RESOLUTIONS FOR A VOTE OF MEMBERSHIP APPROVAL AT THE ANNUAL MEETING THAT IS HELD IN NOVEMBER OF EACH YEAR AND IS OPEN TO THE PUBLIC. PANELS DISCUSSING THE VARIOUS ISSUES ALONG WITH LUNCHEON AND DINNER SPEAKERS PROVIDE INSIGHTS AND INFORMATION AND ARE OPEN TO QUESTIONS FROM THE AUDIENCE THAT NORMALLY EXCEEDS 200 PEOPLE. POWDER RIVER MEMBERS WRITE LETTERS TO THE EDITORS AND EDITORIALS TO LOCAL AND STATE WIDE NEWSPAPERS ADDRESSING THE ISSUES ON WHICH OUR ORGANIZATION IS WORKING ON. EVERY YEAR POWDER RIVER SPONSORS SCHOLARSHIPS AT THE WYOMING HIGH SCHOOL STATE SCIENCE FAIR FOR SCIENCE PROJECTS THAT PROMOTE CONSERVATION AND EDUCATION ON THE PRAIRIE ECOSYSTEMS OF WYOMING. THIS FAIR IS VISITED BY THOUSANDS OF STUDENTS AND ADULTS EACH YEAR. POWDER RIVER BASIN RESOURCE COUNCIL IS THE ONLY GROUP IN WYOMING THAT ACTIVELY ADDRESSES BOTH AGRICULTURAL AND CONSERVATION ISSUES. THE GROUP UNITES BOTH INDIVIDUALS WITH STRONG CONSERVATION CONVICTIONS AND AGRICULTURALISTS WITH A DEEP RESPECT FOR THE LAND AROUND A SHARED VISION TO PROTECT AND IMPROVE WYOMING'S QUALITY OF LIFE. ALSO, POWDER RIVER IS THE ONLY GROUP THAT ADDRESSES SPLIT ESTATE AND PRIVATE PROPERTY RIGHTS IN ADDITION TO PUBLIC LAND ISSUES. POWDER RIVER PUBLISHED A SEVEN POINT PLAN TO PROTECT GROUNDWATER, WHICH WAS RELEASED IN LATE JANUARY 2013. THE REPORT PROMPTED A MEETING WITH THE BOARD OF DIRECTORS OF POWDER RIVER AND THE GOVERNOR AND HIS TOP STAFF ALMOST IMMEDIATELY AFTER ITS RELEASE. SOME OF THE RECOMMENDATIONS IN THE PLAN WERE ADOPTED BY THE GOVERNOR AND STAFF IN THEIR STATE ENERGY PLAN THAT WAS RELEASED IN MAY. THE BOARD OF DIRECTORS, AT THE REQUEST OF THE GOVERNOR'S ENERGY STRATEGY STAFF SUBMITTED TO THE GOVERNOR OUR RECOMMENDATION FOR WATER TESTING PRIOR TO DRILLING AND DURING ONGOING DEVELOPMENT INCLUDING FRACKING. THE GOVERNOR'S OFFICE SPONSORED A RULE MAKING ON WATER TESTING BEFORE THE WYOMING OIL AND GAS CONSERVATION COMMISSION (WOGCC) AND POWDER RIVER'S PARTICIPATED IN THAT PROCESS. OUR WORK ON THIS ISSUE ESPECIALLY ON THE CONTAMINATION IN THE PAVILLION AREA, WAS THE MAJOR IMPETUS FOR THE GOVERNOR TO PUSH FORWARD WITH THIS RULEMAKING. POWDER RIVER DID GET SOME AREAS OF CONCERN INTO THE RULEMAKING, SUCH AS THE AMOUNT OF METHANE IN WATER MEASUREMENT, BUT OVERALL WE COULD NOT SUPPORT THE WATER TESTING PLAN AS PROTECTIVE TO PROPERTY OWNERS. IN JUNE DEB THOMAS, STAFF AND JOHN FENTON AND KRISTI MOGEN MEMBERS TRAVELED TO WASHINGTON DC TO TALK ABOUT THE NEGATIVE IMPACTS OF OIL AND GAS DEVELOPMENT WITH FEDERAL ADMINISTRATORS. THE TRIP WAS AN EFFECTIVE WAY OF GETTING GRASSROOTS INFORMATION TO THE DECISION MAKERS. POWDER RIVER FILED A PETITION BEFORE THE WYOMING OIL AND GAS CONSERVATION IN MAY CALLING FOR REDUCED FLARING AND FOR EXTENDED SETBACKS FOR DRILLING PADS FROM RESIDENCES, SCHOOLS, HOSPITALS AND OTHER AREAS. THE PETITION IS UNDER CONSIDERATION BY THAT BODY BUT IT WAS NOT TAKEN UP FORMALLY. HOWEVER MOST OF THE PROVISIONS ARE BEING CONSIDERED THROUGH RULEMAKING AND SOME ARE BEING IMPLEMENTED. THE PETITION WAS DEVELOPED BY OUR MEMBERS AND STAFF, AND THE PETITIONERS ARE FOUR OF OUR FAMILIES AND SIX GRASSROOTS WYOMING ORGANIZATIONS ALONG WITH POWDER RIVER BASIN RESOURCE COUNCIL AS THE LEAD PETITIONER. WE HAVE BEEN EXPANDING OUR OIL AND GAS ORGANIZING EFFORTS TO ADDRESS THE IMPACTS TO OUR MEMBERS IN THE SOUTHERN POWDER RIVER BASIN, CONVERSE COUNTY AND SOUTHEAST WYOMING. THE MEMBERS IN THE DOUGLAS AREA ARE IMPACTED BY DRILLING, FLARING AND FRACKING EMISSIONS AND HAVE WORKED DOGGEDLY AND SUCCEEDED IN GETTING SOME OF THESE PROBLEMS ADDRESSED BY THE WYOMING OIL AND GAS CONSERVATION COMMISSION (WOGCC) AND INDUSTRY. OVER THE PAST YEAR OUR MEMBERS HAVE BEEN MONITORING THE AIR POLLUTION NEAR DRILLING RIGS WITH THE SUPPORT OF GLOBAL EARTH MONITORING. POWDER RIVER STRONGLY OPPOSED AN INDUSTRY REQUESTED INJECTION WELL PERMIT FOR WATER CONTAMINATED FROM OIL AND GAS DEVELOPMENT. ALTHOUGH INDUSTRY SAYS THE AQUIFER INTO WHICH THE WASTE WATER WILL BE INJECTED IS TOO DEEP FOR USE, THAT SAME AQUIFER WHICH VARIES IN DEPTH IS USED FOR DRINKING WATER IN SOME AREAS. POWDER RIVER SPOKE AGAINST THE PERMIT AT THE WOGCC HEARING AT WHICH THE WOGCC APPROVED THE REQUEST, DESPITE THE OPPOSING VOTES OF THE STATE GEOLOGIST AND THE OTHER GEOLOGIST ON THAT BOARD. WE ALSO HIRED AN EXPERT, WELL RECOGNIZED HYDROLOGIST WHO REVIEWED THE INFORMATION AND PROVIDED US WITH A REPORT WHICH WAS GIVEN TO THE EPA AND THE WOGCC WHICH QUESTIONS THE VALIDITY OF THE INJECTION WELL. THE FINAL APPROVAL FOR THE EXEMPTION MUST BE BY THE EPA. POWDER RIVER AND OUR AFFILIATE THE PAVILLION AREA CONCERNED CITIZENS HAVE BOTH WRITTEN LETTERS TO THE EPA ASKING THEM TO NOT APPROVE THE INJECTION WELL PERMIT. THE EPA HAS ACTED BY SENDING A LETTER TO THE COMMISSION ASKING IT AND THE COMPANY TO RESPOND TO THE INADEQUATE INFORMATION PROVIDED IN THE REQUEST AND THE WOGCC DECISION AND TO INFORM THAT THEY DO NOT CONSIDER THE AQUIFER EXEMPTION APPROVED OR FINAL. POWDER RIVER LED A COALITION OF STATE AND NATIONAL GROUPS INCLUDING THE WYOMING OUTDOOR COUNCIL, THE OIL AND GAS ACCOUNTABILITY PROJECT/EARTHWORKS AND OMB WATCH TO TACKLE THE TRADE SECRET EXEMPTIONS UNDER THE WYOMING FRACKING DISCLOSURE LAW. THIS COALITION FILED A WYOMING PUBLIC RECORDS ACT REQUEST WITH THE WOGCC FOR ACCESS TO ALL DISCLOSURE DOCUMENTS, FRACKING CHEMICALS AND DOCUMENTATION WHEN TRADE SECRET EXEMPTIONS ARE GIVEN. REPRESENTED BY EARTH JUSTICE WE MOVED FORWARD WITH A LAWSUIT FILED IN MARCH 2012 IN STATE DISTRICT COURT OVER THE FAILURE OF WYOMING TO RELEASE THE SPECIFIC CHEMICALS - NOT THE RECIPE IN FRACKING - AND THE CHEMICAL ABSTRACT NUMBER. THE HEARING WAS HELD IN JANUARY 2013 WITH THE DECISION RELEASED IN MARCH. THE DECISION UPHELD THE TRADE SECRET PROVISION FOR FRACKING CHEMICAL DISCLOSURE AS PRACTICED BY THE WOGCC. THE COALITION HAS APPEALED THE RULING TO THE WYOMING SUPREME COURT AND WAS HEARD IN DECEMBER. THE DECISION OF THE EPA TO TURN OVER THE INVESTIGATION OF CONTAMINATED GROUND WATER IN PAVILLION TO THE STATE OF WYOMING WAS VERY DISHEARTENING TO OUR MEMBERS AND THE ORGANIZATION. THE EPA DRAFT RESEARCH REPORT TITLED, INVESTIGATION OF GROUND WATER CONTAMINATION NEAR PAVILLION, WYOMING WILL NO LONGER PROCEED THROUGH A PEER REVIEW PROCESS. POWDER RIVER AND OUR AFFILIATE THE PAVILION AREA CONCERNED CITIZENS (PACC) HAVE DECRIED THE DECISION BUT HAVE MOVED AHEAD TO ESTABLISH A COORDINATION WITH THE STATE AND ITS AGENCIES VIA A LETTER TO THE GOVERNOR TO INSURE INPUT INTO THE PROCESS. OUR IMMEDIATE PAST CHAIR OF THE BOARD OF DIRECTORS, JOHN FENTON, IS A MEMBER OF THE WORKING GROUP COORDINATING WITH THE STATE. PACC HAD RECOMMENDED EXPERTS TO THE STATE TO REVIEW THE CURRENT INFORMATION AVAILABLE. CISTERNS ARE BEING INSTALLED WITH WYOMING STATE FUNDS IN SEVERAL OF THE RESIDENCES IN THE AREA, ALTHOUGH AT A SLOW RATE. WORC IS SUPPORTING A PETITION CALLING ON THE EPA TO CONTINUE THE PROCESS THEY HAD STARTED AND FINISH WITH A PEER REVIEW OF THEIR STUDY. POWDER RIVER CONTINUES TO TRACK COMPANIES BEFORE THE WOGCC AND BLM THAT ARE BEHIND IN RECLAMATION BONDING AND THE STATUS OF RECLAMATION WORK. WHILE WE EXPECT TO CONTINUE TO SEE AN INCREASE IN COMPANIES THAT FAIL TO PLUG AND RECLAIM CBM WELLS DUE TO THE LOW NATURAL GAS PRICES THE ISSUE AT THE STATE AND FEDERAL LEVEL IS BEING ELEVATED. THE STATE AND FEDERAL AGENCIES ARE WORKING TO COLLECT ADDITIONAL BONDING FOR SHUT IN OR IDLE WELLS. A GREATER EMPHASIS IS BEING PLACED BY BLM ON RECLAMATION OF CBM WELLS AND THEY ARE SPONSORING LOCAL WORKSHOPS TO PROMOTE RECLAMATION. IN CONJUNCTION WITH REGIONAL AND NATIONAL ALLIES, WE CONTINUE OUR EFFORTS TO INFLUENCE PROGRESSIVE AGRICULTURAL POLICY. COUNTRY OF ORIGIN LABELING IS AGAIN BEING CHALLENGED.
