	MARITIME SAFETY AND SECURITY ISSUES ----------------------------------- The Council addressed various maritime security policies and concerns for the international liner shipping industry, and provided analysis and advice to the U.S. government on various security policy issues and programs. The following are some of the specific issues in which the Council is involved: A. Maritime Security and Safety Regulation Incorrectly declared weights of containerized cargo shipments continue to present safety issues for container stowage and ship operations. The Council worked with the International Maritime Organization (IMO) and with IMO member governments to develop and have adopted an international requirement that all such containers' weights be verified before being loaded on a vessel. The Council also participated in a joint effort by the IMO, the International Labor Organization, and the UNECE to revise the "IMO/ILO/UNECE Guidelines for packing of cargo transport units (CTUs)" to become a "Code of Practice", applicable to the whole supply chain and to all modes of transport. That effort resulted in the adoption of a modernized and more useful document designed to improve the safety of containerized cargo transportation. The Council conducted a survey of its Members regarding the number of shipping containers lost overboard worldwide (e.g. from extreme weather events) and submitted the results to the IMO in order to better inform discussions about measures that may be available to reduce the loss of containers and better report such incidents when they do occur. B. Customs and Border Protection (CBP) Automation Initiatives The Council worked with U.S. CBP in addressing technical and programming issues associated with automating the electronic filing of export manifests. The Council also worked with CBP in transitioning the manifest filing systems from CBP's Automated Manifest System (AMS) to the ACE ocean/rail manifest (M1), and in further developing the International Trade Data System (ITDS), which will provide a U.S. "single window" for collection of international trade data used by multiple U.S. government agencies. The Council continues to identify situations in which paper forms can be replaced with electronic filing systems and to pilot and implement those transitions from paper to electronic systems. C. European Commission Container Security Regulation The Council worked with the European Commission on the revision of the European Union's advance cargo information filing, including detailed technical discussions regarding the form, content, and filing methods for entry and exit summary declarations, as well as the possible development of a uniform European electronic manifest. The Council has educated EU officials on the trade implications of a wide range of EU proposals for implementation of the Union Customs Code.

	ENVIRONMENTAL ISSUES -------------------- A. Vessel Air Emissions The Council worked on the following government initiatives dealing with vessel air emissions: 1) Implementation and documentation of compliance with the U.S. - Canadian 200 mile emission control area (ECA) adjacent to North American shores to reduce sulfur, NOx ("nitrogen oxide") and particulate matter emissions. 2)Proposals within the European Union to address carbon emissions from ships. 3)Various proposals at the IMO to address carbon emissions from ships. B. Ballast Water Regulation The Council worked with the EPA and the U.S. Coast Guard to address coordination and implementation of separate ballast water treatment requirements under the separate statutory authority of the two agencies. The Council also worked with the California on its efforts to implement ballast water regulations, and with the IMO as it plans to implement a new international convention on ballast water treatment. C. Whale Protection The Council provided comments to the National Oceanic and Atmospheric Administration regarding measures to reduce ship strikes of North Atlantic right whales.

	LINER SHIPPING REGULATORY SYSTEM -------------------------------- The Council followed the various regulatory activities of the Federal Maritime Commission under the Shipping Act regulatory regime, and submitted an amicus curiae brief to the Commission in a case involving the interpretation of central provisions of the shipping act. The Council also provided industry comments to the European Commission with respect to its review of the block exemption under EU competition law for liner shipping consortia agreements.

PART III, LINE 4D - OTHER PROGRAM SERVICE ACCOMPLISTMENTS:	I. CARGO LIABILITIY ------------------- The Council was a member of the U.S. delegation to the United Nations Commission on International Trade Law ("UNCITRAL"), which developed a new international cargo liability convention, known as the Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea. The convention has been signed by numerous UN member states, and it will enter into force after ratification by 20 countries. The new convention contains most of the elements included in the WSC agreement with the National Industrial Transportation League at the beginning of the UNCITRAL negotiation process. The Council continues to work with the United States Department of State to position the convention for ratification by the United States. II. Public Relations -------------------- The Council undertakes various initiatives to better explain the international liner shipping industry to the public and interested government officials. This may take place through Congressional testimony, filings with regulatory agencies, and public speeches. Another way the Council does this is through its website, which can be found at www.worldshipping.org, and which provides further details on the work of the Council.
