Form 990, Part X, Section n/a, Line 34b	In September 2011, the Association requested an exemption from the Internal Revenue Service from filing the Form 990 since it is an affiliate of a governmental unit as described in Rev. Proc. 95-48, 1995-2 C.B. 418. The Association meets at least two of the affiliation factors listed in Rev. Proc. 95-48, Section 4.03. The Mutual Domestic Water Consumers Associations were first authorized by the New Mexico State Legislature in 1947 under the Sanitary Projects Act and are a political subdivision of the state and public bodies according to the Act. Their support is received principally from fees collected pursuant to statutory authority in the form of water usage rate collections. They are required to submit annually information comparable to that required by the Form 990 and are subject to financial audit by the State of New Mexico. Per Rev. Proc 95-48, Section 4.04 The Association does not have taxable subsidiaries or participate in joint ventures with other non-exempt entities. It also does not engage in public fund-raising efforts, nor do the associations activities provide significant benefits to private interests. The request from the Internal Revenue Service was accompanied by Form 8940, Request for Miscellaneous Determination. All relevant information as well as the filing fee were submitted with the application. Numerous attempts have been made to obtain a ruling on the application with no success. The Association will report this 990 as a final return based upon the relevant revenue procedures mentioned above.
