OUR CLIENT, THE ROBERT ARTHUR SEALE FOUNDATION, IS FILING 2013 FORM 990-PF FOR THE PERIOD ENDING SEPTEMBER 30, 2014 AFTER THE ORIGINAL DUE DATE OF FEBRUARY 16, 2015. FORM 8868 APPLICATION FOR EXTENSION OF TIME TO FILE AN EXEMPT ORGANIZATION RETURN WAS FILED TIMELY ON FEBRUARY 16, 2015 EXTENDING THE DUE DATE OF 2013 FORM 990-PF THROUGH MAY 15, 2015. THE RETURN WAS OVER-LOOKED BY OUR FIRM UNTIL VERY RECENTLY WHEN WE DISCOVERED THE ERROR WHICH WE IMMEDIATELY CORRECTED BY PREPARING THE RETURN AND BY REVISING OUR METHODS OF DETECTING RETURNS WHICH COULD POTENTIALLY BE OVER-LOOKED, IN THIS CASE DUE TO BEING A FORM 990 HAVING A FISCAL YEAR END OF SEPTEMBER 30TH. THE REPORTS WE USED TO MONITOR UPCOMING DUE DATES DID NOT REFLECT A FORM 990-PF HAVING A FISCAL YEAR END OF SEPTEMBER 30TH. IN ADDITION, THE STAFF ACCOUNTANT WHO HAS PREPARED THE RETURN FOR THE PREVIOUS THREE YEARS IS NO LONGER WITH THE FIRM AND THEREFORE WAS NOT AVAILABLE TO CATCH THE OVER-SIGHT. OUR FIRM TAKES RESPONSIBILITY FOR THE FAILURE TO COMPLY BY FILING THE ROBERT ARTHUR SEALE FOUNDATION 2013 FORM 990-PF TIMELY, AS THE CLIENT RELIES ON US TO ENSURE THE PROPER DEADLINES ARE MET. THIS WAS SIMPLY AN OVER-SIGHT AND NOT WILLFUL OR INTENTIONAL ON THE PART OF THE TAXPAYER OR OUR FIRM. ALL IN ALL, THE ROBERT ARTHUR SEALE FOUNDATION IS BEING ASSESSED A 3,397 PENALTY FOR FILING A LATE EXEMPT ORGANIZATION AND CERTAIN TRUST RETURN WHICH IS BEING FILED TEN MONTHS AFTER THE EXTENDED DUE DATE OF MAY 15, 2015. WE UNDERSTAND THAT THE PROPER USE OF PENALTY ASSESSMENT HELPS DETER NON-COMPLIANCE WITH TAXPAYERS. HOWEVER, WE FEEL THAT A PENALTY OF THIS MAGNITUDE BASED ON THE TAXPAYER'S HISTORY OF COMPLIANCE IS NOT BEING ADMINISTERED FAIRLY. THE TAXPAYER HAS BEEN USING OUR FIRM TO PREPARE ALL REQUIRED TAX FILINGS FOR THE ROBERT ARTHUR SEALE FOUNDATION SINCE INCEPTION IN OCTOBER OF 2001. DUE TO THE FISCAL YEAR-END OF SEPTEMBER 30TH IT IS VERY DIFFICULT FOR THE CLIENT TO KEEP TRACK OF THE DUE DATES AND EXTENDED DUE DATES OF THE FOUNDATION BEING THAT ALL OTHER RETURNS FILED BY THE FOUNDATION'S PRESIDENT ARE BASED ON CALENDAR YEAR END FILINGS. THE TAXPAYER SHOULD NOT BE SUBJECT TO THE PENALTY FOR LATE FILING EXEMPT ORGANIZATION AND CERTAIN TRUST RETURNS SINCE IT IS NOT THE IRS' INTENTION TO PENALIZE AN INNOCENT ERROR ON THE PART OF A TAXPAYER WHO STRIVES TO MAINTAIN COMPLIANCE WITH THE IRS.
