Government Affairs - If Membership is the heartbeat of VVA, the work we do at Government Affairs is the soul. Along with representing veterans with their disability compensation claims and appeals, the work we do is, fundamentally, the raison detre for our very existence: to influence legislative and policy decisions at the highest levels of government in the Department of Veterans Affairs and other federal entities, in the Congress, in the White House.To accomplish this, We testified at numerous hearings before the Veterans Affairs Committees in both the House and the Senate; often, we submitted testimony for the record on issues when we were not among those VSOs or MSOs that testified before lawmakers. We sent letters on specific pieces of legislation or proposed shifts in policy to the sponsors of select bills, to the chair and ranking member of the SVAC and/or HVAC, to the Secretary of Veterans Affairs. We have done Call Ins to Congressional offices regarding the Toxic Exposure Research Act, as well as leading a Twitter Storm on pending legislation in the Senate.Our Executive Director for Policy and Government Affairs had breakfast monthly with the Secretary, during which he brought up specific issues often things about which the Secretary knew little, if anything. VVA also met regularly with the Undersecretary for Health at VA, as well as the Secretary of Benefits at VA. We met with staff of the Veterans Affairs Committees, of individual senators and members of Congress, of the Veterans Health and Veterans Benefits Administrations, and at the White House to discuss issues of concern to veterans and to our families, our dependents, our survivors.Finally, we selected issues of importance that we highlighted in our column that runs in the bimonthly VVA Veteran and on the VVA website. Over the past year, much of our focus legislatively has been to move the Toxic Exposure Research Act (H.R. 1769 and S. 901) through the legislative process, to the point that almost half of both the Senate and the House have signed on as co-sponsors. Much of the credit for our success must go to the strong support from the VVA Chapters and State Councils working in coordination with the Officers and the Policy & Government Affairs staff. Of course, this has hardly been our only focus. In the realm of the effects of toxic exposures, specifically to the defoliants and herbicides so liberally sprayed across South Vietnam, we assisted the crews and support staff in Reserve units who flew contaminated C-130s win their fight with the VA for health care and disability compensation; and we have worked to move legislation that would make sailors on ships plying the waters off the coast of South Vietnam eligible for care and compensation as well. We have also worked hard on behalf of the veterans of the first Gulf Was suffering from toxic wounds, and on behalf of the veterans of the post 9/11 veterans and their families.Fixing various facets of the operation of the VA, including how appeals are adjudicated and how the so-called Choice Act is implemented, has occupied hundreds of staff hours. Of course, this has hardly been our only focus. In the realm of the effects of toxic exposures, specifically to the defoliants and herbicides so liberally sprayed across South Vietnam, we assisted the crews and support staff in Reserve units who flew contaminated C-130s win their fight with the VA for health care and disability compensation; and we have worked to move legislation that would make sailors on ships plying the waters off the coast of South Vietnam eligible for care and compensation as well. We have also worked hard on behalf of the veterans of the first Gulf Was suffering from toxic wounds, and on behalf of the veterans of the post 9/11 veterans and their families.Fixing various facets of the operation of the VA, including how appeals are adjudicated and how the so-called Choice Act is implemented, has occupied hundreds of staff hours. Importantly, we have been true to the founding principle of Vietnam Veterans of America: Never again will one generation of veterans abandon another. We have worked closely with the newest and youngest veterans and their organizations to assist them however we can, offering guidance and supporting their endeavors and their causes.VVA has worked hard to ensure easier and effective access to employment and training resources are available to veterans separating post 9/11, especially for disabled veterans. In this, we worked closely with the Assistant Secretary of Labor for Veterans Employment & Training, as well as elements of the VA, VetJobs.com, and the Chamber of Commerce Foundation job fairs. VVA has pursued efforts to ensure that assistance for veteran owned businesses and service disabled owned small businesses (SDVOSB) are expanded, including being party to a suit against VA, winning at the Supreme Court 8-0, a unanimous decision in favor of putting veterans first in procurement at the VA. As a result many more SDVOSB will be able to obtain contracts with the VA.

The VVA Veteran - During FY15 the department known as The VVA Veteran once again published six issues of the magazine on time and under budget. This work is an intensive collaboration of authors, writers, photographers, illustrators, researchers, and printers. And that doesnt include our core staff of writers, editors, proofreaders, advertising coordinator, and designer and art director. And that doesnt include those ancillary in-house contributors: the staffs of the Finance Department, Membership, and Government Affairs, in particular. And all that wouldnt be possible without the input and enthusiasm of those members in the field who have a story they want to share. In addition to the print version, six electronic issues were designed and uploaded to the Internet at vvaveteran.org. These electronic issues, while similar in content, are entirely reconfigured to meet the expectations of a younger generation and of researchers. The magazines website also accommodates the variety of electronic devices. Facebook.vvaveteran.org is maintained by Veteran staff. It reports quick news and chapter events, as well as political and cultural happenings. During the 2015 Convention, Facebook updates were made every few hours. Book in Review II has developed into a major online depository for reviews of books relevant to the Vietnam War and its veterans. Similarly, Arts of War on Line reports on films, plays, exhibits, and other products inspired by the war. Sample articles throughout the year were:Americas Veterans Courts: In January 2008 Judge Robert Russell launched the Buffalo Veterans Treatment Court. The extraordinary success of his vision, modeled on drug and mental health treatment courts but bringing the VA and veteran-mentors into the justice system, has caused it to be replicated across the country. Bernie Edelman examines the Buffalo court and compares it to the recently established veterans court in suburban Virginia.Wes Studi, The Edge of Courage: Wes Studi is probably Americas best-known Native American actor. He became famous with Dances with Wolves and provided the smoldering anger that powered The Last of the Mohicans. Writer Richard Currey questions him about his commitment to strong portrayals of American Indians. He asks him, too, about the influence of the Vietnam War on his life and professional ambitions. The Good News about Hep C: Time was, hep C was a death sentence, and it was a sentence disproportionately meted out to Vietnam veterans. Now, Claudia Gary explains, the future seems much brighter, and new therapiesthough extensiveall but guarantee a complete cure.Son repatriates his Father: Holly Shanks chronicles how one man refused to let his fathers remains stay in Southeast Asia. His determination and perseverance paid off.

Veterans Benefits Program - For FY15, veterans and dependents with VVA POA (Powers of Attorney) received a total of $791.6 Million in on-going compensation, pension, & DIC benefits, of which $502.0 Million (63.4%) was from states with VVA Service Programs who are receiving VVA grant funding. These amounts do not include retro awards. The total retro awards won in FY 15 was $89.0 million. These statistics are based on 2,981 new awards in FY15.For FY 15 our win ratio at the Board of Veterans Appeals was 79.9% (29.0% grants + 50.9% remands). The denial rate was 16.1%.These statistics are based on 876 VVA cases decided in FY15. Litigation won in FY15: C-123 Case. In April 2015, Yale Law School Veterans Clinic prepared a memorandum on behalf of the C-123 Veterans Association and VVA explaining that reservists who were exposed to herbicides aboard contaminated C-123s are immediately eligible for service-connected disability compensation because these reservists were injured during their training. After receiving a report from the Institute of Medicine (January 9, 2015), VA decided to acknowledge exposure to Agent Orange for personnel whose military service involved regular contact with the contaminated C-123 aircraft. This includes individuals who performed service in the Air Force or Air Force Reserve who regularly operated, maintained, or served onboard C-123 aircraft known to have been used to spray herbicides during the Vietnam era. In August 2015, VA reported that it began awarding compensation for C-123 Agent Orange claims.

Veterans Health Council (VHC) - During the past year the Veterans Health Council (VHC) continued its efforts to both educate and inform Americas veterans, their families, and its partners in the health care communities about the illnesses and maladies associated with military service. For example, to date, more than 100,000 copies of the VHC brochure have been distributed nationwide to veterans, their families, and others in the health care community through such public events as Veterans Day parades around the country, the NAACP annual meeting, the annual meeting of the United Auto Workers (UAW) Veterans Conference in Black Lake, Michigan. Through the brochure alone, the VHC has influenced public policy by bringing awareness to the diseases, maladies, and illnesses associated with military service, and by describing the process for filing a VA claim for disability compensation. In addition to Congressional briefings and presentations at professional meetings, trainings and academic conferences, we partnered with VHC members such as the Mens Health Network to propose legislative changes in the US Preventive Services Task Force evaluation standards to include stakeholder evidence prior to USPSTF panel evaluations of clinical preventive services; with the Health Leadership Council to repeal the Independent Payment Advisory Board (IPAB); and joined with other VHC members and friends to oppose proposed changes to Medicare prescription drug policies. The VHC also launched a national public service education awareness campaigns directed at Americas veteran community focusing on hepatitis-C. Both VVA President John Rowan and VHC Executive Director, Dr. Tom Berger, participated in numerous local, national and international print and broadcast media interviews, and Dr. Berger was a participant in a number of national veterans health program broadcasts and Webinars sponsored by the likes of SAMHSA, the Defense Centers of Excellence, the National Crisis Center, and the Veterans Health Administration. The VHC has continued to expand its partnerships with other members of the health advocacy community to develop educational outreach initiatives on the implementation of the federal health care reform statute, including Congressional briefings that focus on the importance of inclusion of veteran stakeholders in health care public policy. We also continue the development of the Veterans Health Council as a forum for the discussion of health care policy and its impact on veterans and their families. In addition, we use the communication resources of Vietnam Veterans of America (VVA) for outreach to military and veterans networks for dissemination of educational materials, information updates and reports designed to raise awareness of key public policy issues affecting veterans access to care, including such issues as IPAB, Medicare Parts B and D, and essential health benefits.

Footnote for uncertain tax position under FIN 48 (Part X) The accounting standard on accounting for uncertainty in income taxes addresses the determination of whether tax benefits claimed or expected to be claimed on a tax return should be recorded in the financial statements. Under that guidance, The Association may recognize the tax benefit from an uncertain tax position only if it is more likely than not that the tax position will be sustained on examination by taxing authorities based on the technical merits of the position. Examples of tax positions include the tax-exempt status of The Association and various positions related to the potential sources of unrelated business income tax (UBIT). The tax benefits recognized in the financial statements from such a position are measured based on the largest benefit that has a greater than 50% likelihood of being realized upon ultimate settlement. There were no unrecognized tax benefits related to uncertain tax positions identified or recorded as liabilities for the current year.The Associations policy would be to recognize interest and penalties, if any, on tax positions related to its unrecognized tax benefits in income tax expense in the financial statements. No interest and penalties were assessed or recorded during the year.
