Explanation

Part V, Line 4: Intended uses of the endowment fund.

THE PERMANENT MAINTENANCE FUND WAS ESTABLISHED TO PROVIDE FOR FUTURE FUNDING OF CEMETERY MAINTENANCE AND OPERATIONS. THE FUND'S INCOME IS TRANSFERRED TO THE GENERAL FUND MONTHLY TO PROVIDE FOR CURRENT OPERATIONS. THE PRINCIPAL OF THE FUND IS PERMANENTLY RESTRICTED.

The Association is exempt under Section 501(c)(13) of the Internal Revenue Code and is not liable for any federal income taxes. The Association is subject to routine audits by IRS; however, there are currently no audits for any tax periods in progress. Accounting principles generally accepted in the United States of America require management to evaluate tax positions taken and recognize a tax liability (or asset) if the entity has taken an uncertain position that more likely than not would not be sustained upon examination by the Internal Revenue Service (IRS). Management has not analyzed the tax positions taken by the Association as this is not required by the accounting practices permitted by the Division of Cemeteries of the State of New York.
