| FORM 990, PART VI, QUESTION 6, 7A & 7B | There shall be eight membership classifications in AGC GA: General Contractor, Specialty Contractor, Supplier/Service Provider, Educational Institution, Student, Young Constructor, Honorary and Insurance. --- (A) GENERAL CONTRACTOR MEMBERS. A General Contractor Member is an individual or corporation, partnership, joint venture or other entity doing business, in whole or in substantial part, as a General Contractor, as further provided below, who upon formal application for membership has been duly elected by the Board of Directors, as herein provided, based upon the determination such applicant meets the following criteria and be duly elected pursuant to Article VIII: (1) Has met the requirements for and holds (1) a general or light commercial contractor license under the laws of Georgia, (2) a utility contractor license under the laws of Georgia, or (3) GA DOT Certification to perform work for that department that would otherwise require a general or light commercial license or utility license under the laws of Georgia. (2) Is engaged in the business of construction contracting as a General Contractor, including construction management and design-build construction functions as defined in the respective Georgia licensing statutes in the commercial, light commercial, building, highway, transportation, heavy, public works, utility, industrial or other similar field. (3) At least fifty-one percent (51%) of its total gross construction revenue derived during the immediately preceding fiscal year was derived from performing such general contracting work as a prime contractor or construction manager or design-builder under direct contract with the Owner with overall responsibility for the satisfactory completion of a project. (4) Has an established reputation for Skill, Integrity, and Responsibility. (5) Agrees and commits to subscribe to and support the Bylaws, policies, principles, and purposes of AGC GA and National Association. General Contractor Members may use the name and appropriate emblem that represents their respective membership classification in the National Association and AGC GA. Only General Contractor Members may vote and serve as Officers, except as otherwise expressly provided in Article XI. --- (B) SPECIALTY CONTRACTOR MEMBER. A Specialty Contractor Member is an individual or corporation, partnership, joint venture or other entity, doing business as a contractor, that does not satisfy the requirements for membership as a General Contractor Member stated in Subpart (A), above, but that upon formal application for membership has been duly elected by the Board of Directors as provided in Article VIII based upon the determination that such applicant meets the following criteria: (1) Has been engaged in the construction industry as a subcontractor, specialty trade contractor, or firm providing labor, labor and equipment, or labor and materials, directly or indirectly to a construction site. (2) Has an established a reputation of Skill, Integrity, and Responsibility. (3) Agrees and commits to subscribe to and support the Bylaws, policies, principles, and purposes of AGC GA and National Association. Specialty Contractor members shall not use the copyrighted AGC General Contractor Member emblem, but may utilize the Specialty Contractor membership emblems of AGC GA and the National Association. These members may receive publications and other services of AGC GA, but may not vote or hold office except as otherwise provided herein. --- (C) SUPPLIER/SERVICE PROVIDER MEMBER. A Supplier/Service Provider Member is an individual or corporation, partnership, joint venture or other entity, that does not satisfy the requirements for membership as a General Contractor Member or Specialty Contractor Member stated in Subparts (A) and (B), above, but that upon formal application for membership has been duly elected by the Board of Directors of AGC GA as provided in Article VIII based upon the determination that such applicant meets the following criteria: (1) Has been engaged as (a) construction material, equipment, or other product supplier to the construction industry; or (b) a provider of professional or other services to the construction industry as a substantial part of their business. This group includes providers of banking, accounting, insurance, consulting, and/or legal services; architects; and engineers; as well as consumers of construction services, i.e., developers and public and private owners. This group does not include labor union organizations. (2) Has established a reputation of Skill, Integrity, and Responsibility. (3) Agrees and commits to subscribe to and support the Bylaws, policies, principles, and purposes of AGC GA and National Association. Supplier/Service Provider members shall not use the copyrighted AGC General Contractor Member emblem, but may utilize the Supplier/Service Provider membership emblems of AGC GA and the National Association. These members may receive publications and other services of AGC GA, but may not vote or hold office except as otherwise provided herein. --- (D) EDUCATIONAL INSTITUTION MEMBER. An Educational Institution Membership may be granted to an accredited educational institution or a department or other unit of such an institution. To qualify for such membership, either the institution or its department or other unit must offer and support instruction in a degree program relating to construction or building science, construction management, architecture or design, or civil or other engineering discipline required of the construction industry. The institution, department or other unit may hold such a membership in the Association only for so long as it offers and supports such a program. A qualified institution or department or unit of such an institution upon application and election by the Board of Directors pursuant to Article VIII, may be elected as an Educational Institution Member. The Educational Institution Membership shall entitle the holder and its active faculty and professional staff to participation in membership meetings and to receive electronic publications, but not the privilege to vote or hold office, and shall not use the copyrighted emblems of AGC GA or the National Association. --- (E) STUDENT MEMBER. A Student Membership may be granted as an individual and direct membership in AGC GA to an individual actively engaged in and pursuing an educational degree at an accredited educational institution in construction or building science, construction management, architecture or design, or civil or other engineering discipline required of the construction industry. A qualified individual, upon formal application for membership and election by the Board of Directors of AGC GA pursuant to Article VIII, may hold such a Student Membership in the AGC GA during their full-time or part-time enrollment in such a degree program, including periods of cooperative employment relating to such program and until the individual receives such a degree. The Student Membership shall entitle the holder participation in membership meetings and to receive electronic publications, but not the privilege to vote or hold office and shall not use the copyrighted AGC Member emblems of AGC GA or the National Association. The Board of Directors shall have the power and authority within its discretion to form Student Chapters for particular educational institutions having multiple Student members in its enrollment. --- (F) YOUNG CONSTRUCTOR MEMBER. A Young Constructor Membership may be granted as an individual and direct membership in AGC GA to an individual who does not own or work for a General Contractor or other Member firm, but must hold a degree from an accredited educational institution in construction or building science, construction management, architecture or design, or civil or other engineering discipline required of the construction industry, or manage or supervise significant operations for a construction firm, or serve as a professional consultant to the construction industry. A qualified individual, upon formal application for membership and election by the Board of Directors pursuant to Article VIII, may hold Young Constructor Membership in AGC GA during the first five years that follow the date on which the individual receives such a degree or begins to serve the construction industry in such a capacity, unless or until such individual shall own or become employed by a Member firm. However, an individual may hold such a membership for no more than three of those five years. The Young Constructor Membership shall entitle the holder to participation in membership meetings and to receive electronic publications, but not the privilege to vote, hold office, or display the copyrighted emblems of AGC GA or the National Association. --- (G) HONORARY MEMBER.
