Return Reference	Explanation
Part X, Line 2:	The Trust established under the Plan to hold the Plan's assets qualifies under Section 501(c)(9) of the Internal Revenue Code (IRC) and is, therefore, not subject to tax under present income tax law. Once qualified, the Trust is required to operate in conformity with the IRC to maintain its qualification. The Trust Administration is not aware of any action or event that has occurred that might affect the Trust's qualified status. Although tax-exempt health and welfare benefit plans are not generally subject to taxation, certain activities of the Plan may be taxable. The investment income of a VEBA may be subject to unrelated business income tax (UBIT) to the extent that assets exceed certain account limits for health, disability, life, and other benefits. Additionally, unrelated business taxable income (UBTI) of a tax-exempt entity is subject to taxation. The Plan will recognize future accrued interest and penalties related to unrecognized tax benefits in income tax expense if incurred. The Plan has accrued an income tax refund receivable of $6,648 and $131,397 related to UBIT for the year ended March 31, 2016 and 2015. Explanation

Part X, Line 2:

The Trust established under the Plan to hold the Plan's assets qualifies under Section 501(c)(9) of the Internal Revenue Code (IRC) and is, therefore, not subject to tax under present income tax law. Once qualified, the Trust is required to operate in conformity with the IRC to maintain its qualification. The Trust Administration is not aware of any action or event that has occurred that might affect the Trust's qualified status. Although tax-exempt health and welfare benefit plans are not generally subject to taxation, certain activities of the Plan may be taxable. The investment income of a VEBA may be subject to unrelated business income tax (UBIT) to the extent that assets exceed certain account limits for health, disability, life, and other benefits. Additionally, unrelated business taxable income (UBTI) of a tax-exempt entity is subject to taxation. The Plan will recognize future accrued interest and penalties related to unrecognized tax benefits in income tax expense if incurred. Each Trustee shall review, read, and agree to the Policy on an annual basis.
