THE TRUST HAS OBTAINED A FAVORABLE TAX DETERMINATION LETTER DATED SEPTEMBER 23, 2003 FROM THE INTERNAL REVENUE SERVICES, AND THE PLAN SPONSOR BELIEVES THAT THE TRUST QUALIFIES AND OPERATED IN ACCORDANCE WITH APPLICABLE PROVISIONS OF THE IRC. THEREFORE, NO PROVISION FOR INCOME TAXES HAS BEEN INCLUDED IN THE PLAN'S FINANCIAL STATEMENTS. THE TRUST HAS OBTAINED A FAVORABLE TAX DETERMINATION LETTER DATED SEPTEMBER 23, 2003 FROM THE INTERNAL REVENUE SERVICES, AND THE PLAN SPONSOR BELIEVES THAT THE TRUST QUALIFIES AND OPERATED IN ACCORDANCE WITH APPLICABLE PROVISIONS OF THE IRC. THEREFORE, NO PROVISION FOR INCOME TAXES HAS BEEN INCLUDED IN THE PLAN'S FINANCIAL STATEMENTS. U.S. GAAP REQUIRES PLAN MANAGEMENT TO EVALUATE TAX POSITIONS TAKEN BY THE PLAN AND RECOGNIZE A TAX LIABILITY (OR ASSET) IF THE ORGANIZATION HAS TAKEN AN UNCERTAIN TAX POSITION THAT MORE LIKELY THAN NOT WOULD NOT BE SUSTAINED UPON EXAMINATION BY THE IRS. THE PLAN IS SUBJECT TO ROUTINE AUDITS BY TAXING JURISDICTIONS; HOWEVER, THERE ARE CURRENTLY NO AUDITS IN PROGRESS FOR ANY TAX PERIODS. THE PLAN ADMINISTRATOR BELIEVES THE PLAN IS NO LONGER SUBJECT TO INCOME TAX EXAMINATIONS FOR YEARS PRIOR TO 2012.
