The President shall notify the Executive board of any LM-30 filings and make them available to the Executive Board upon request. The U.S. DOL requires Union officers and employees to disclose: (a) whether they or certain family members hold any interest in or receive any benefit from employers whose employees the Union represents or seeks to represent; Union affiliated trusts, vendors to the Union or major vendors to represented employers, and (b) whether they have engaged in certain other transactions. Individuals disclose these potential conflicts of interest annually by filing an LM-30 form with the DOL. The Union enforces and monitors compliance with its conflicts policy by examining the LM-30 forms and making them available to the Union's governing body. In this manner, the governing body is made aware if any officer or employee (or his/her immediate family) has an interest that may conflict with his/her responsibilities to the Union. Further, the Labor Management Reporting and Disclosure Act prohibits Union officers from "holding or acquiring any pecuniary or personal interest which conflicts with the interest of such organization". (29 U.S.C. Sec.501). Any member may sue to enforce this provision. The governing body or a member may bring internal charges against an officer or employee for violating the conflict of interest policy. All such charges are investigated by the governing body. |
