| FORM 990, PART III, STATEMENT REPORTING CASES LITIGATED BY A PUBLIC | INTEREST LAW FIRM: 1. Chuitna Citizens Coalition, et al. v. Alaska Dept. of Natural Resources. Trustees for Alaska represents Plaintiffs Chuitna Citizens Coalition and Cook Inletkeeper in state court challenge against the Alaska Department of Natural Resources for its unreasonable and unlawful delay in adjudicating pending instream flow reservation applications to protect salmon habitat. Status of the case: The State of Alaska adjudicated three instream flow reservation applications with one granted in favor of Plaintiffs. Administrative appeal filed by industry groups, and the Superior Court ordered a decision by August 28, 2018. A motion for entry of final judgment was filed and fully briefed but not decided by the end of the year. 2. Sturgeon, et al. v. Frost, et al. Trustees for Alaska represents the National Parks Conservation Association, The Wilderness Society, American Rivers, Center for Biological Diversity, Sierra Club, Wilderness Watch, Denali Citizens Council, Copper Country Alliance, Alaska Quiet Rights Coalition, Northern Alaska Environmental Center, Friends of Alaska National Wildlife Refuges, Alaska Wilderness League as amici curiae in a federal district court challenge to the National Park Service's authority to regulate activities on navigable waters within Park boundaries. Amici support the Defendant National Park Service's authority. Status of the case: After the Supreme Court remanded the case to the Ninth Circuit, the Ninth Circuit again ruled for the National Park Service. Defendant again sought a writ of certiorari with the U.S. Supreme Court, which was granted. Briefing is underway. 3. State of Alaska v. Jewell; Safari Club, Int'l v. Jewell; Alaska Prof. Hunters Assoc. v. Dept. of the Interior. Trustees for Alaska represents Intervenor-defendants Alaska Wildlife Alliance, Alaskans for Wildlife, Friends of Alaska National Wildlife Refuges, Denali Citizens Council, Copper Country Alliance, Kachemak Bay Conservation Society, Northern Alaska Environmental Center, Defenders of Wildlife, National Parks Conservation Association, National Wildlife Refuge Association, The Wilderness Society, Wilderness Watch, Sierra Club, Center for Biological Diversity, and the Humane Society of the United States to defend National Park Service and U.S. Fish and Wildlife Service predator control regulations. Status of the case: The cases were consolidated in January of 2018. The case was stayed in June 2018 in light of agencies' new regulatory process. 4. Stand for Salmon v. Mallott. Trustees for Alaska represents ballot initiative sponsor organization in a state court challenge of the Lt. Governor's decision not to certify the initiative because it is an unconstitutional appropriation. Status of the case: Alaska Superior Court issued summary judgment for Plaintiff. 5. Friends of Alaska National Wildlife Refuges, et al. v. Zinke, et al. Trustees for Alaska represents Friends of Alaska National Wildlife Refuges, The Wilderness Society, Defenders of Wildlife, National Audubon Society, Wilderness Watch, Center for Biological Diversity, National Wildlife Refuge Association, Alaska Wilderness League, and Sierra Club as Plaintiffs in a lawsuit challenging the Department of the Interior's land exchange agreement with the King Cove Corporation to trade away lands within Izembek National Wildlife Refuge's designated Wilderness. Status of the case: Case filed and motions for summary judgment briefed. 6. Northern Alaska Environmental Center, et al. v. U.S. Dept. of the Interior, et al. Trustees for Alaska represents Northern Alaska Environmental Center, Alaska Wilderness League, Defenders of Wildlife, the Sierra Club, and The Wilderness Society as Plaintiffs in a lawsuit challenging the agencies' failure to analyze the environmental impacts of the 2017 decision to lease lands for oil and gas development in the National Petroleum Reserve-Alaska under the National Environmental Policy Act. Status of the case: Case filed and motions for summary judgment briefed. |
