Return Reference	Explanation
Amended return information	The taxpayer experienced a change in management in the summer of 2021 and and hired a new tax preparer to complete the 2020 Form 990. An extension was filed by May 15, 2021 by the previous tax preparer. The new tax preparer attempted to file what she believed to be the original return on November 15, 2021. The return was rejected by IRS because apparently this return has already been filed. Neither the new management nor the old management of Edward Schultz American Legion Post 697 have any knowledge of previously filing this return. The taxpayer is filing this amended return to supercede the information on the unknown original return.
Members or stockholder classes and rights Part VI line 6	The post has about 220 members. There is only one class of members and all members are part of the governing body of the post. The governing body of the post elects the seven positions in the House Committee. The House Committee must obtain the approval of the members (ie, the governing body) for any proposed expenditure greater than $5,000. This is done by presenting a proposal to the membership at the monthly meeting and obtaining a simple majority vote of the members that are present.
Governing body decisions Part VI line 7b	The post membership is the governing body of the organization and has the right to vote on all matters presented before it. The House Committee that is elected by the membership (ie, the governing body) has the right tio approve expenditures less than $5,000 without presenting the matter to the membership.
