    The IRS should waive any penalties or abate any penalties assessed against the Taxpayer in connection with the late filing of its Form 2020-PT because the facts and circumstances surrounding its failure to file/pay in a timely manner constitute reasonable cause.The IRS will waive a failure to pay/file penalty if the taxpayer can show that the failure is due to reasonable cause and not due to willful neglect. Reasonable cause is granted when the taxpayer can show that it exercised ordinary business care and prudence in determining its tax obligation, but is unable to comply with those obligations. Se Regs. Section 301.6651-1(c). In the instant case, Taxpayer, exercised ordinary business care and prudence in filing its 2020 Form 990-PF.Taxpayer retained an attorney experienced in tax return preparation to prepare its 2020 Form 990-PT. The same attorney had prepared Taxpayers Form 990-PT for many years and taxpayer relied on the attorney to timely file its 2020 Form 990-PT. The attorney informed Taxpayer that due to the extended personal income tax filing due date, as well as the demands of a family illness, the attorney would need to file an extension for Taxpayers 2020 Form-PT and Taxpayer believed an extension to file its 2020 Form 990-PT until November 15, 2021 had been granted. Taxpayer received a notice dated October 11, 2021 indicating that its 2020 Form 990-PT had not been filed. Taxpayer notified the attorney of the notice and the attorney informed Taxpayer that an extension had been granted and that the return would be filed prior to November 15, 2021. It was not the until the attorney went to e-file Taxpayers Form 990-PT on 11-15-21 that the attorney became aware that the extension to file Taxpayers 2020 return had not been filed as the attorney beleived and had represented to the Taxpayer. Taxpayer has always timely filed its Form 990-PT since its inception in 2008. Taxpayer exercised ordinary business care and prudence in relying on the attorney who had filed the return in the past to timely file Taxpayers 2020 return and it was reasonable for Taxpayer to rely on its attorneys assurance that that return had been extended and would be timely filed by the extended due date. Taxpayer respectfully submits that these circumstances constitute reasonable cause and indicate a lack of willful neglect. Thus, the IRS should waive any penalties or abate any penalties assessed in this matter.
