On October 25, 2022, the former staffer for the Kansas Truth Caucus happened to check the post office box that we previously used to use for our organization. Previously, correspondence from the Internal Revenue Service had been sent to this former staffer's personal address so he did not think to check the old PO Box, as it is no longer in use by our organization. In addition, we have received no notice at our current address (PO Box 606, Hesston, KS 67062) nor had he received anything at his personal address as in the past (10229 Millstone Drive Apt 3102, Lenexa, KS 66220). In addition, when he had last checked the old post office box in late June, neither notice had arrived. So, this appears to be a case of having several wires crossed in regard to notices, hence the delay. Had we received this notice at the address we were accustomed to, we would have replied right away. What was particularly frustrating about the receipt of this letter and the IRS's inclusion of the originally filed 990-EZ return is that in October 2021, we received a letter (at 10229 Millstone Drive Apt 3102, Lenexa, KS 66220, the address at which staff had received previous IRS correspondence) from the IRS indicating we had not filed the 990-EZ at all. Upon receiving this notice in October 2021, we immediately sent it again by Certified Mail. What we received today was the original filing sent earlier in 2021 (not the resent 990-EZ mailed in October 2021)-proof that the original return was filed by mail in despite the letter from the Internal Revenue Service last fall indicating it had not been. We now are facing a significant penalty based on crossed wires within the IRS regarding both our original 990-EZ return received by the IRS on July 6, 2021, as well as the return resent at IRS's request in October 2021. In hindsight, the 2020 tax year was the first (and only) tax year that the organization crossed the financial threshold for filing a full 990 return instead of the 990-EZ. We would have immediately corrected this error had we found out that we filed the wrong return, but due to extended delays in receiving and processing our return by the IRS, as well as the multiple addresses the IRS was sending various notices to over the course of 2021 and 2022, we were unaware of the issue until just a few days ago. Due to the circumstances just described, KTC respectfully request that the penalty be waived.
