Form 990, Part VI, Section A, Line 4	Effective September 17, 2021, the Organization was reconstituted as North Dearborn Water Authority with the Indiana Secretary of State pursuant to Indiana Code Section 13-18-16-16. North Dearborn Water Authority 1) is considered a political subdivision of the State, 2) is subject only to the laws applicable to nonprofit water utilities and local water corporations, 3) remains obligated under any existing contracts or agreements, and remains obligated and assumes the indebtedness of the nonprofit water utility, 4) retains all its powers, privileges, rights and exemptions as a nonprofit water utility under its existing bylaws and articles and all laws applicable to nonprofit water utilities including powers of eminent domain, and 5) will have its rate and charges set pursuant to Indiana Code Section 8-1.5-3-8. The Board determined that the reorganization will be of public benefit to the general welfare of the Organization and ratepayers without impairing rights, powers, privileges and exemptions or the Organization.
