| Letter number LTR2694C dtd 2023-02-13 | We respectfully request abatement of any potential penalty. The COMPLETE return was initially filed timely on November 11 2022. However, you returned the filing during February 2023. There was NO missing information as your February 13 2023 correspondence did not cite or request any missing information. You demanded simply that the return be filed electronically. The software to complete that function was not available at the time of your notice but has since been procured to facilitate this filing. In addition, the IRS granted Disaster Relief Postponement for filings and obligations that were due after December 27 2022 but before October 16 2023, to October 16 2023 for Taxpayers in Los Angeles County California. As the filing was not returned till February 2023, it is our position that this qualifies for that postponement and is therefore still filed timely. We implore your agreement and request that no penalties be assessed. Respectfully submitted. |
