Schedule D, Part X, Line 2 FIN 48 (ASC 740) footnote Uncertain tax positions are recognized and measured under provisions in FASB ASC 740. Under these provisions, a tax position is recognized as a benefit only if it is "more likely than not" that the tax position would be sustained in a tax examination, with a tax examination being presumed to occur. The amount recognized is the largest amount of tax benefit that is greater than 50% likely of being realized on examination. For tax positions not meeting the "more likely than not" test, no tax benefit is recorded. A current tax liability or asset is recognized for the estimated payable or refund on tax returns for the year. Deferred tax liabilities or assets are recognized for the estimated future tax effects of temporary differences between financial reporting and tax accounting. Deferred tax liabilities result primarily from temporary differences associated with Spartan's solar array and future taxability of patronage capital allocations received by Spartan. In 2016, Spartan began recognizing accelerated (and bonus) depreciation, for tax purposes, of its 2016 solar array. Accelerated (and bonus) depreciation has also been utilized for tax purposes of its 2019 solar array. Accelerated tax depreciation creates a timing difference in the recognition of depreciation expenses that are deductible for tax purposes but are not yet recognized for financial reporting purposes. Patronage capital allocations are recognized as revenue for financial reporting purposes but are not recognized as taxable revenue until received from the associated organization. Deferred tax assets result from recognition of expenses for financial reporting purposes that are not deductible for tax purposes until paid and from future tax benefits. Deferred tax assets also result from the carryforward of NOLs and ITCs. Deferred tax assets are recorded within other assets on the consolidated balance sheets. Schedule J, Part I, Line 3 Arrangement used to establish the top management official's compensation No compensation is paid by Peninsula Generation Cooperative (Peninsula) to its president. His salary is provided by a related organization, Wolverine Power Supply Coopertive (Wolverine). He receives no additional pay from Wolverine for his work on Peninsula's behalf. Wolverine determines his compensation using comparability data from compensation surveys and studies of other organizations in the area and similar organizations on a national basis.
Schedule J, Part I, Line 4b Supplemental nonqualified retirement plan Director Baker participated in a non-qualified, non-funded retirement plan as part of his employment for Wolverine (related organization) since 2014. He became fully vested in 2020. He received no distributions from the plan in 2023 and no amount became substantially vested in 2023.
