SELF DEALING FORM 4720, SCH A, PART I, (D) DESCRIPTION OF ACT NUMBERS 1-7 THE SUMMIT CHARITABLE FOUNDATION, INC. ("TSF OR THE "FOUNDATION") CHANGED IT PROVIDERS MID-YEAR OF 2024. A SUBSEQUENT REVIEW OF ITS MICROSOFT 365 LICENSES LED TO THE DISCOVERY THAT CERTAIN EMAIL ADDRESSES ASSOCIATED WITH SANT ASSOCIATES, LLC ("SA") , WHICH IS A DISQUALIFIED PERSON WITH RESPECT TO TSF, HAD BEEN INADVERTENTLY ADDED TO THE FOUNDATION'S MICROSOFT 365 ACCOUNT, FIRST OCCURRING IN 2017. THIS RESULTED IN TSF ACCIDENTALLY FURNISHING EMAIL SERVICES (I.E., THE MICROSOFT 365 SERVICES PAID FOR BY TSF) TO SA IN THE YEARS 2017 THROUGH 2024. TSF PROMPTLY REQUESTED THAT ITS IT PROVIDER HAVE THE SA EMAIL ADDRESSES REMOVED FROM THE ACCOUNT AND CONFIRMED THAT AS OF SEPTEMBER 10, 2024, THOSE EMAIL ADDRESSES NO LONGER APPEAR ON ITS MICROSOFT 365 ACCOUNT. TSF ALSO RECEIVED REIMBURSEMENT FROM SA IN THE AMOUNT OF $2,233.00 ON SEPTEMBER 24, 2024. THE $2,233.00 REPRESENTS THE COST OF THE MICROSOFT 365 ACCOUNT ALLOCABLE TO THE EMAIL ADDRESSES ASSOCIATED WITH SA PLUS INTEREST, FOR 2017 THROUGH 2024. GOING FORWARD, THE MICROSOFT 365 ACCOUNTS WILL BE REVIEWED ON AN ANNUAL BASIS TO ENSURE THAT NO FUTURE INCIDENT OF THIS TYPE OCCURS. THE EXTERNAL IT PROVIDER HAS BEEN EDUCATED TO NOT ADD ANY UNAPPROVED ADDRESSES TO THE FOUNDATION'S MICROSOFT 365 ACCOUNTS AND TO NEVER ADD ANY EMAIL ADDRESSES THAT DO NOT END IN "SUMMITFDN.ORG," WHICH IS THE EMAIL EXCHANGE FOR TSF STAFF. PLEASE NOTE THERE ARE EIGHT DIFFERENT 4720'S BEING FILED, ONE FOR EACH YEAR THAT WAS IMPACTED (2017-2024). FOUR OF THESE YEARS (2017, 2018, 2019 AND 2020) ARE BEING FILED VIA PAPER DUE TO SOFTWARE LIMITATIONS. THE 2024 YEAR WILL BE FILED ELECTRONICALLY IN 2025 ONCE THE TAX PREPARERS SOFTWARE IS UPDATED FOR THIS FILING ABILITY. PRIOR TO 2024, SA WAS A PARTNERSHIP THAT WAS REGARDED FOR TAX PURPOSES AND WAS OWNED MORE THAN 35% BY ROGER SANT. MR. SANT IS A DISQUALIFIED PERSON WITH RESPECT TO THE FOUNDATION. AS OF JANUARY 2024, SA IS A DISREGARDED ENTITY AND MR. SANT IS ITS SOLE MEMBER. ACCORDINGLY, THE NAME OF THE SELF-DEALER PROVIDED IN PART II, FOR ACT 8, ON THE FORM 4720 FOR THE TAX YEAR 2024 IS MR. SANT. THE NAME OF THE SELF-DEALER PROVIDED IN PART II FOR EACH OF THE ACTS THAT OCCURRED IN YEARS 2017-2023 IS SANT ASSOCIATES, LLC.
